Florida – Governor Ron DeSantis has taken a definitive step towards addressing the issue of homelessness in Florida with the signing of HB 1365. This legislation aims to ensure the safety of Florida’s streets while also providing essential services to homeless individuals. By requiring counties to offer mental health and drug addiction services in designated locations away from public streets, the bill seeks to balance public safety with support for the homeless.

A New Approach to Public Safety and Support

Governor DeSantis emphasized that Florida’s strategy is to prevent homeless encampments from compromising the well-being of its citizens, contrasting the situation with other states. “Florida will not allow homeless encampments to intrude on its citizens or undermine their quality of life like we see in states like New York and California,” he stated. The governor also added that this legislation upholds Florida’s dual commitment to maintaining law and order and to assisting homeless individuals in regaining their independence.

This move is seen as a proactive approach to a problem that has become increasingly visible in urban areas across the United States. Representative Sam Garrison highlighted the need for action, remarking on the failures of cities like San Francisco and Los Angeles to address homelessness effectively. He said, “This bill will not eliminate homelessness. But it is a start. And it states clearly that in Florida, our public spaces are worth fighting for. The status quo is not an option. In Florida, we choose to act. It is simply the right thing to do.”

Senator Martin added that the legislation would provide a structured framework for various groups, from government agencies to non-profits, to serve homeless individuals more effectively. By doing so, the bill aims to restore public spaces to their intended purposes, ensuring that parks, sidewalks, and streets are accessible and enjoyable for everyone.

Key Provisions of HB 1365

HB 1365 introduces several notable measures to tackle homelessness:

  • The legislation prohibits homeless individuals from camping in public spaces such as streets, sidewalks, and parks. Instead, it requires that they be placed in temporary shelters where they will be monitored by law enforcement agencies.
  • It grants the state of Florida the necessary enforcement tools to ensure compliance by local governments.
  • Occupants of homeless shelters will be required to abstain from drug use.
  • These shelters will offer substance abuse and mental health treatment to their occupants.

Additionally, the legislation provides alternatives for instances where shelters reach their maximum capacity. It directs the Department of Children and Families to authorize temporary campsites equipped with essential sanitation facilities, access to substance abuse and mental health treatment resources, and strict prohibitions against the use of illegal substances and alcohol.

Through these measures, HB 1365 aims not only to provide immediate support to homeless individuals but also to ensure Floridians have access to safe public spaces.
